Subject to these Terms of Service (this "Agreement"), sigmamails.com ("Sigma, Sigma Mails", "we", "us" and/or "our") provides access to Sigma's cloud platform as a service (collectively, the "Services"). By using or accessing the Services, you acknowledge that you have read, understand, and agree to be bound by this Agreement. If you are entering into this Agreement on behalf of a company, business or other legal entity, you represent that you have the authority to bind such entity to this Agreement, in which case the term "you" shall refer to such entity. If you do not have such authority, or if you do not agree with this Agreement, you must not accept this Agreement and may not use the Services.

1. Acceptance of Terms

By signing up and using the services provided by Sigma (referred to as the "Service"), you are agreeing to be bound by the following terms and conditions ("Terms of Service"). The Service is owned and operated by Sigma ("Us", "We", or "Our").

2. Description of Service

Sigma provides an email management tool ("the Product"). The Product is accessible at sigmamails.com and other domains and subdomains controlled by Us (collectively, "the Website").

3. Fair Use

You are responsible for your use of the Service and for any content that you post or transmit through the Service. You may not use the Service for any purpose that is illegal or infringes upon the rights of others.

4. Intellectual Property Rights

You acknowledge and agree that the Service and its entire contents, features, and functionality, including but not limited to all information, software, code, text, displays, graphics, photographs, video, audio, design, presentation, selection, and arrangement, are owned by Us, our licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You must comply with all applicable third party terms of service when using the Service. In particular you must comply with Google's policies: https://www.google.com/gmail/about/policy/

7. Data Encryption

We do our best to ensure all user data is secure in transit and at rest. Using an industry accepted encryption standard to encrypt user data that is:

  • Stored on portable devices or portable electronic media
  • Maintained outside of Google's or your systems
  • Transferred across any external network not solely managed by you
  • At rest on your systems
  • Transmitting data using secure modern protocols (for example, over HTTPS)
  • Keeping user data and credentials, specifically tokens such as OAuth access and refresh tokens, encrypted at rest
  • Ensuring keys and key material are managed appropriately, such as stored in a hardware security module or equivalent-strength key management system.,
  • 8. Google TOS Compliance

    We comply with https://developers.google.com/workspace/workspace-api-user-data-developer-policy and operate under the umbrella of an approved use case: Built-in and web email clients that allow users to compose, send, read, and process email via a user interface. Applications that enhance the email experience for productivity purposes (such as applications for customer relationship management, delayed sending of email or mail merge, or providing generative AI summaries) We use these gmail apis for "productivity purposes", enhancing users abilities to manage their inboxes by extending core functionality through contact management. This allows users to manage what emails they see more effectively, as well as improving the efficiency of managing their inbox organization. WE ASSERT THAT WE ARE NOT A SERVICE INTENDED FOR ANY OF THE FOLLOWING UNAPPROVED USE CASES: Mobile keyboards. Applications that export email on a one-time or manual basis. Applications that store or backup data other than email messages in Gmail. Applications that use multiple accounts to abuse Google policies, bypass Gmail account limitations, circumvent filters and spam, or otherwise subvert restrictions. Applications that distribute spam or unsolicited commercial mail. For example, applications that send bulk commercial mail, such as customer relationship management, are approved as long as the user consented to receive emails. Additionally, we ensure that data obtained through the Google API is subject to limited uses such that data must be used for the purpose of providing or improving user-facing features that are prominent in Sigma's user interface. We do not use the data for any other purposes. Data will not be transferred to external sources in any way. Humans will never read the data except for in the following cases: we first obtained the user's affirmative agreement to view specific messages, files, or other data, with the limited exception of use cases approved by Google under additional terms applicable to the Nest Device Access program; It is necessary for security purposes (for example, investigating a bug or abuse); It is necessary to comply with applicable law; or The data (including derivations) is aggregated and used for internal operations in accordance with applicable privacy and other jurisdictional legal requirements. All other transfers, uses, or sale of user data is completely prohibited, including: Transferring or selling user data to third parties like advertising platforms, data brokers, or any information resellers. Transferring, selling, or using user data for serving ads, including retargeting, personalized or interest-based advertising. Transferring, selling, or using user data to determine credit-worthiness or for lending purposes. Transferring, selling, or using user data to create, train, or improve a machine learning or artificial intelligence model beyond that specific user's personalized model for the appropriate use case or user-facing feature.

    10. Changes to these Terms

    We reserve the right to revise and update these Terms of Service from time to time in our sole discretion. All changes are effective immediately when we post them, and apply to all access to and use of the Website thereafter. Your continued use of the Website following the posting of revised Terms of Service means that you accept and agree to the changes.

    12. Disclaimer of Warranties

    THE SERVICE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, THE WARRANTY OF TITLE, MERCHANTABILITY, NON-INFRINGEMENT OF THIRD PARTIES' RIGHTS, AND FITNESS FOR PARTICULAR PURPOSE.

    13. Limitation of Liability

    IN NO EVENT WILL WE, OUR AFFILIATES OR THEIR LICENSORS, SERVICE PROVIDERS, EMPLOYEES, AGENTS, OFFICERS OR DIRECTORS BE LIABLE FOR DAMAGES OF ANY KIND, UNDER ANY LEGAL THEORY, ARISING OUT OF OR IN CONNECTION WITH YOUR USE, OR INABILITY TO USE, THE WEBSITE, THE SERVICE, ANY WEBSITES LINKED TO IT, ANY CONTENT ON THE WEBSITE OR SUCH OTHER WEBSITES, INCLUDING ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. The service is not liable for any mail missed or lost due to the use of the service, especially in cases where the user either muted or blocked senders or if the syncing algorithm fails to gather mail. It is the user's responsibility to actively check their original email providers inbox for critical mail.

    14. Governing Law and Jurisdiction

    These Terms of Service and any dispute or claim arising out of or related to them, their subject matter or their formation (in each case, including non-contractual disputes or claims) shall be governed by and construed in accordance with the internal laws of the State of Delaware without giving effect to any choice or conflict of law provision or rule. Any legal suit, action, or proceeding arising out of, or related to, these Terms of Service or the Website shall be instituted exclusively in the federal courts of the United States or the courts of the State of Delaware.

    By using Sigma, you acknowledge that you have read these Terms of Service, understood them, and agree to be bound by them. If you do not agree to these Terms of Service, you are not authorized to use the Service. We reserve the right to change these Terms of Service at any time, so please review them frequently.
